Terms of Service
Last Updated: October 21, 2026
1. Acceptance of Terms
By downloading, installing, or using FloodRoute ("the App") or the floodroute.com website ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the App or the Site.
The Site includes the Markdown versions of its pages (a page's address followed by ".md"), machine-readable files such as /llms.txt, and the Historical Flood Estimates and Datasets described in Section 9A.
FloodRoute is a flood risk visualization application operated by Axiomic, LLC, a California limited liability company, 1 Blackfield Dr PMB 216, Tiburon, California 94920, United States ("the Company"). FloodRoute is made in Marin County, California by Marc Hoag / Skyriven Studios, a project of Axiomic, LLC. "You" and "your" refer to the user of the App. "We," "us," and "our" refer to the Company.
2. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 13, you may not use the App. If you are under 18, you may use the App only with the involvement of a parent or guardian, who must make any purchase. This App is designed for adult drivers assessing flood risks on roadways.
3. Critical Safety Warning
DRIVING THROUGH FLOODED ROADS CAN RESULT IN SERIOUS INJURY OR DEATH.
Floodwater can:
- Sweep away vehicles in as little as 6 inches of moving water
- Cause drowning — most flood deaths occur in vehicles
- Hide road damage, debris, and open manholes
- Contain sewage, chemicals, and hazardous materials
- Be deeper than it appears
This App provides ESTIMATES ONLY. Flood predictions may be inaccurate, incomplete, or outdated. You must NEVER rely solely on this App for safety decisions.
Alerts may be late, missing, or wrong. Notifications are calculated on your device from the most recent forecast the App downloaded. They depend on your device being on, connected, and allowed to show notifications, and can be silenced by iOS settings such as Focus modes.
Do not use the App while driving. Check conditions before you set out, or have a passenger check.
ALWAYS follow guidance from local authorities, emergency services, and official flood warning systems.
4. Description of Service
FloodRoute is a flood risk visualization application for coastal tidal flooding. It combines pre-generated road elevation data with NOAA tide predictions and live water levels to estimate which coastal roads may flood now or at forecasted tide levels. The App enables users to:
- View flood risk estimates for coastal roads in supported towns
- Browse tide forecasts and flood windows, and receive alerts for dangerous high tides
- Submit community flood condition reports, optionally with notes and photos, and view, confirm, or flag reports from others
- Share flood forecasts and maps through links that open on the Site
- Request coverage for new towns
- Save places and, with FloodRoute Pro, receive street-level alerts for saved places and commutes
Core features, including the live flood map, are free. Optional paid features ("FloodRoute Pro") are described in Section 4A. We may add, change, or remove features, supported towns, and data sources at any time.
4A. FloodRoute Pro, Purchases, and the Free Trial
What Pro includes. FloodRoute Pro currently includes street-level alerts for up to three saved places, commute alerts, the 30-day planner, the what-if simulator, and alerts for additional towns. The free version includes one saved place. The App shows what is included before you buy.
Purchases. Pro is offered as an auto-renewing monthly or yearly subscription, or as a one-time "Lifetime" purchase, through the Apple App Store. Prices are shown in the App before you buy. Purchases are processed by Apple through the App Store: payment is charged to your Apple ID and is handled entirely by Apple under Apple's Media Services Terms, and the App confirms your purchase with Apple. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period; you can manage or cancel them in your Apple ID settings. Deleting the App or your data does not cancel a subscription. Refunds are handled by Apple under its policies. On a new device or after reinstalling, use "Restore purchases" in the App, signed in with the same Apple ID, to restore Pro.
Lifetime. A Lifetime purchase gives you Pro features for as long as we offer FloodRoute Pro in the App, without a subscription. It is tied to your Apple ID, cannot be transferred, and the specific features included may change over time as described in Section 4.
Free trial. Starting with your first launch of FloodRoute 2.0, you receive Pro free, without entering any payment details, until two days after the next notable high tide forecast for your town — at least 7 days and at most 30 days. When the trial ends, the App switches to the free features automatically; you are never charged unless you choose to buy Pro. One trial is available per device. Any separate App Store free trial or introductory offer will be described by Apple before you buy.

7. Assumption of Risk and Your Responsibility
LIKE A GPS NAVIGATION SYSTEM, this App provides guidance that may be incorrect, incomplete, or outdated. You must use your own judgment at all times.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
- USE YOUR BEST JUDGMENT — You are responsible for evaluating actual conditions
- YOU ARE SOLELY RESPONSIBLE for your own actions, decisions, and safety
- OBSERVE ACTUAL CONDITIONS — Look at the road and weather before you, not just the App
- FOLLOW ALL TRAFFIC LAWS and official emergency warnings
- DO NOT DRIVE THROUGH WATER — If you see standing or flowing water, turn around
- USE OF THIS APP IS ENTIRELY AT YOUR OWN RISK
- FLOOD CONDITIONS ARE INHERENTLY DANGEROUS AND UNPREDICTABLE
- NO APP CAN ACCURATELY PREDICT ALL FLOOD EVENTS
- You will NOT HOLD THE COMPANY RESPONSIBLE for any harm resulting from your use of this App
- You understand that FLOOD PREDICTIONS ARE ESTIMATES that may differ significantly from actual conditions
- You will CHECK OFFICIAL SOURCES and follow guidance from local authorities
"TURN AROUND, DON'T DROWN" — This is official guidance from the National Weather Service. If you encounter flooded roadways, do not attempt to cross.
BY USING THIS APP, YOU VOLUNTARILY ASSUME ALL RISKS associated with flood prediction information, including but not limited to the risk of death, personal injury, property damage, and any other damages.
8. Indemnification
You agree to indemnify, defend, and hold harmless the Company, and any of the Company's affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, damages, judgments, awards, losses, costs, liabilities, and expenses (including reasonable attorneys' fees and costs) arising from or relating to:
- Your use of the App
- Your use or distribution of Historical Flood Estimates or Datasets, including any use Section 9A prohibits
- Your violation of these Terms
- Your violation of any rights of any third party
- Any claim that your use of the App caused damage to you or any third party
- Any claim arising from decisions you made based on information provided by the App
- Any claim related to personal injury, death, or property damage allegedly caused by your reliance on the App
This indemnification obligation will survive the termination of these Terms and your use of the App.
9. Data Accuracy Limitations
Flood risk calculations in the App and on the Site — including the Historical Flood Estimates, the Datasets, and the Markdown and other machine-readable versions of Site pages — are based on publicly available data sources that may contain errors:
- NOAA tide predictions and water levels: Forecasts, gauge readings, and historical observations that may be inaccurate, delayed, incomplete, or unavailable, and that are measured at stations that may be miles from a given road
- Open-Meteo rainfall and barometric pressure: Weather data that may be inaccurate, delayed, or incomplete
- USGS elevation data: Sampled at discrete points (approximately 10-meter resolution), not comprehensive surveys of every location
- OpenStreetMap and Overture Maps road data: Community-contributed data that may contain errors, omissions, or outdated information
- FEMA flood zone data: National Flood Hazard Layer designations that may not reflect current conditions, recent development, or local flood control infrastructure
- Community reports: Submitted by other users and not verified by us
WE CANNOT AND DO NOT GUARANTEE the accuracy, completeness, reliability, currentness, or timeliness of any data used by or provided through the App or the Site, including the Historical Flood Estimates and the Datasets.
The App and the Site's live forecasts include estimated effects of rainfall, of current water levels measured at nearby gauges, and of how long water may linger on roads after high tide. These are approximations. The App does NOT forecast or fully account for:
- Storm surge or wind-driven water beyond what nearby gauges currently measure
- River, creek, or flash flooding (FloodRoute covers coastal tidal flooding only)
- Drainage system failures or capacity
- Debris blocking drainage
- Ground saturation beyond rainfall estimates
- Unusual weather conditions
- Changes in infrastructure
- Working drainage systems, tide gates, sea walls, levees, or pumps that may prevent predicted flooding
Historical Flood Estimates and the Datasets are subject to these limitations and to the additional limitations in Section 9A.
Machine-readable versions. The Markdown versions of Site pages, /llms.txt, and similar files are generated from the same data as the Site and have the same limitations. They may be cached, out of date, or incomplete. The Company is not responsible for how search engines, AI assistants, or other third parties read, summarize, or repeat them.
9A. Historical Flood Estimates and Open Data
For covered towns, the Site may show flood history pages and pages for individual dates. These show past high tides and how many roads FloodRoute's model estimates were at risk at those water levels ("Historical Flood Estimates"). The Site may also offer downloadable datasets of these estimates, for example in JSON or CSV format ("Datasets").
Estimates, not records. Historical Flood Estimates and Datasets are modeled estimates. They apply today's road network and road elevations to past water levels observed at NOAA tide stations (NOAA's verified data, currently from about 1996 onward). They are not observations, measurements, or records that any road actually flooded, closed, or became impassable on any date. Whether a road actually flooded depended on many things the estimates do not capture. These include drains, pumps, levees, sea walls, and tide gates; changes to roads and elevations since that date; rainfall, wind, and waves; distance from the tide station; and errors in the elevation data. A road shown as at risk may have stayed dry, and a road not shown may have flooded.
No warranty. Historical Flood Estimates and Datasets are provided "AS IS" and "AS AVAILABLE," without warranty of any kind, and are subject to Sections 5, 6, and 9. We may correct, recalculate, or withdraw them at any time, and results may change as our data and methods change.
Not for property, financial, engineering, or legal decisions. Historical Flood Estimates and Datasets are for general information, research, and public awareness only. They are not designed or suitable for, and should not be relied on for:
- Property valuation or appraisal
- Real-estate listings or disclosures, including natural hazard or flood disclosures
- Insurance underwriting, rating, or claims
- Lending, mortgage, or credit decisions
- Engineering, design, or construction
- Legal, regulatory, permitting, or compliance decisions, including flood zone determinations
Any such use is entirely at your own risk. For official flood hazard information, consult FEMA, NOAA, and your local government.
Open Database License. The Datasets are derived in part from OpenStreetMap data, so they are licensed under the Open Data Commons Open Database License (ODbL) 1.0. You may use, share, and adapt the Datasets under the terms of that license, including its share-alike requirements. Any public use must include this attribution:
FloodRoute (floodroute.com), © OpenStreetMap contributors, NOAA CO-OPS
The ODbL's own disclaimer of warranties and limitation of liability also apply to the Datasets.
Describe them accurately. When you share or publish Historical Flood Estimates or Datasets, or anything derived from them, please describe them as model estimates, not as observations or records of actual flooding or as an official flood determination. Describing them otherwise can mislead people about flood risk, and you alone are responsible for how you describe and use them. You may not suggest that the Company endorses you or your use, and the ODbL grants no rights in the FloodRoute name or logo. Nothing in these Terms limits the rights the ODbL grants in the Datasets.
Everything else is reserved. The ODbL applies only to the Datasets. It grants no rights in the Site's text, design, or software, in the FloodRoute name and logo, or in the App. These remain subject to Section 11.
10. No Professional Advice
The App does not provide professional, emergency, safety, or engineering advice. The information provided is for general informational purposes only and is not intended to be relied upon for safety decisions.
You should consult appropriate professionals and official sources before making any decisions that could affect your safety or property.
11. Intellectual Property
The App and the Site, including their design, text, functionality, flood data compilations, the FloodRoute name and logo, and underlying technology, are owned by the Company and protected by applicable copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved. The Datasets are licensed separately under Section 9A, and nothing in this Section limits the rights that license grants.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal purposes, subject to these Terms and, for Pro features, an active purchase or trial. You may not:
- Modify, copy, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Use any data mining, robots, or similar data gathering methods
- Extract or scrape flood data, elevation data, or other datasets from the App
- Use the App or its data for any commercial purpose without prior written consent
This license terminates automatically if you violate any of these restrictions and may be terminated by the Company at any time.
The Site is public. Search engines and AI assistants may crawl, index, summarize, and link to it, including its Markdown versions and /llms.txt, in line with our robots.txt. When they quote the Site, they should link back to the page they quote and keep its estimates-only and safety context.
11A. User Content and Community Guidelines
You may submit flood reports, notes, photos, confirmations, flags, and town requests ("User Content"). Flood reports and approved photos are public, together with a short contributor tag that lets others see which reports came from the same device (see our Privacy Policy). By submitting User Content you:
- Grant the Company a worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify (for example, to crop or resize), and distribute it in connection with the App, the Site, and flood-prediction research;
- Confirm you have the right to submit it, and that it is accurate to the best of your knowledge;
- Agree not to submit content that is false or misleading, abusive, harassing, hateful, sexually explicit, violent, defamatory, infringing, or that reveals another person's private information (including faces or license plates in photos);
- Agree never to enter flood water, report while driving, or take any other risk to capture a report;
- Agree not to use reports, flags, or confirmations to harass anyone or to manipulate what others see.
We have zero tolerance for objectionable content or abusive users. Users can flag any report and hide all reports from a contributor. Photos are reviewed before they appear publicly, reports flagged by multiple users are hidden automatically, and we review flags and remove violating content within 24 hours of becoming aware of it. We may remove any User Content and block any device from contributing at our sole discretion.
User Content reflects the views of the person who submitted it, not the Company. Community reports are not verified and are subject to every limitation in Sections 3, 5, 6, 7 and 9.
12. Privacy
Your use of the App is also governed by our Privacy Policy, which describes our data collection, use, and sharing practices, including your rights under the CCPA, GDPR, and other applicable privacy laws.
13. Third-Party Services and Data
The App relies on third-party services and data providers including NOAA, USGS, OpenStreetMap, the Overture Maps Foundation, Open-Meteo, FEMA, OpenFreeMap, Apple, Supabase, Vercel, and Formspree (and, in App versions 1.x, RevenueCat and OpenWeatherMap). While we work to ensure App functionality, we cannot guarantee uninterrupted access if these providers experience issues or change their services.
We are not responsible for the accuracy, availability, or reliability of any third-party service or data source. Your interaction with third-party services is governed by their own terms and policies.
13A. Apple App Store Terms
If you downloaded the App from the Apple App Store:
- These Terms are between you and the Company only, not Apple. The Company, not Apple, is solely responsible for the App and its content.
- Your license to use the App is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- The Company, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
- If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, the Company, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms (for example, your wireless data agreement) when using the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce these Terms against you as a third-party beneficiary.
14. Modifications to the App and Terms
The Company reserves the right to modify, suspend, or discontinue the App at any time without notice.
The Company may modify these Terms at any time. If we make material changes, we will notify you within the App at least 30 days before the changes take effect and update the "Last Updated" date. Your continued use of the App after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. Subject to the arbitration provisions below, any dispute shall be resolved exclusively in the state or federal courts located in Marin County, California, and you consent to the personal jurisdiction of such courts.
16. Arbitration, Class Action Waiver, and Jury Trial Waiver
Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the App, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Marin County, California, or remotely at your election. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action Waiver. YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Jury Trial Waiver. TO THE EXTENT PERMITTED BY LAW, YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A JURY TRIAL IN ANY COURT PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP.
Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to contact@axiomic.ai within 30 days of first downloading the App. If you opt out, the Governing Law and Dispute Resolution provisions (litigation in Marin County courts) shall apply.
EU/EEA/UK Users. If you are a consumer residing in the European Union, European Economic Area, or United Kingdom, the binding arbitration and class action waiver provisions above do not apply to you. You may bring proceedings in the courts of your country of residence.
17. Termination
You may stop using the App at any time by deleting it from your device.
We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including violations of these Terms.
Upon termination, your license to use the App is revoked. Sections that by their nature should survive termination — including Disclaimer of Warranties, Limitation of Liability, Historical Flood Estimates and Open Data, Indemnification, and Governing Law — will survive.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions, which shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
20. Waiver
No waiver by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
21. Assignment
You may not assign or transfer your rights under these Terms without the Company's prior written consent. The Company may assign rights and obligations under these Terms without restriction or notice.
22. Force Majeure
The Company will not be liable for any failure or delay in performance resulting from causes beyond reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, internet service provider failures, power outages, or failures of third-party data providers such as NOAA or USGS.
