"your" refer to the user of the App.1. ACCEPTANCE OF TERMSBy downloading, installing, or using the App, you agree to be bound by these Terms of Service. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS APP.2. CRITICAL SAFETY WARNINGDRIVING THROUGH FLOODED ROADS CAN RESULT IN SERIOUS INJURY OR DEATH.Floodwater can:
- Sweep away vehicles in as little as 6 inches of moving water
- Cause drowning - most flood deaths occur in vehicles
- Hide road damage, debris, and open manholes
- Contain sewage, chemicals, and hazardous materials
- Be deeper than it appearsThis App provides ESTIMATES ONLY. Flood predictions may be inaccurate, incomplete, or outdated. DATA ACCURACY LIMITATIONSFlood risk calculations are based on publicly available data sources that may contain errors:- NOAA tide predictions: Forecasts that may be inaccurate or delayed
- USGS elevation data: Sampled at discrete points (approximately 10-meter resolution), not comprehensive surveys of every location
- OpenStreetMap road data: Community-contributed data that may contain errors, omissions, or outdated informationWE CANNOT AND DO NOT GUARANTEE the accuracy, completeness, reliability, currentness, or timeliness of any data used by this App.The App does NOT account for:
- Rainfall or storm surge
- Drainage system failures
- Debris blocking drainage
- Ground saturation
- Unusual weather conditions
- Changes in infrastructure8. NO PROFESSIONAL ADVICEThe App does not provide professional, emergency, safety, or engineering advice. The information provided is for general informational purposes only and is

GOVERNING LAW AND DISPUTE RESOLUTIONThese Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions.Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Marin County,
California, and you consent to the personal jurisdiction of such courts.11. ARBITRATION AND CLASS ACTION WAIVERBinding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the App, including the determination of the scope or
applicability of this agreement to arbitrate, shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and
Procedures. The arbitration shall take place in Marin County, California, or remotely at your election. The arbitrator's decision shall be final and binding,
and judgment on the award may be entered in any court of competent jurisdiction.Class Action Waiver. YOU AND THE DEVELOPER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF
OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may
not preside over any form of class or representative proceeding.Small Claims Exception. Notwithstanding the foregoing, either party may bring an individual action in small claims court.Opt-Out. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first downloading the App. If you
opt out, the Governing Law and Dispute Resolution provisions (litigation in Marin County courts) shall apply.12. SEVERABILITYIf any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms
unenforceable or invalid as a whole. Such provisions shall be deleted without affecting the remaining provisions, which shall continue in full force and
effect.13. ENTIRE AGREEMENTThese Terms constitute the entire agreement between you and the Developer regarding the App and supersede all prior and contemporaneous understandings,
agreements, representations, and warranties.14. WAIVERNo waiver by the Developer of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a

- FEMA: National Flood Hazard Layer flood zone designations (pre-bundled)When fetching tide data, your IP address may be visible to NOAA's servers.4. Location DataFloodRoute does not access your device's location. You manually select your region from the available options.5. NotificationsFloodRoute uses local notifications to alert you about dangerous high tides. These notifications are scheduled entirely on your device based on NOAA tide
predictions. No notification data is sent to external servers. You can enable or disable notifications and choose which regions to receive alerts for in the
app's Settings.6. Data Storage and DeletionFlood risk data is stored locally on your device. Subscription status is managed by RevenueCat.You can delete all local app data at any time using the "Delete Account" option in Settings. This removes all preferences, notification settings, and cached
data from your device. Note that deleting app data does not cancel any active subscriptions—you must manage subscriptions separately through Apple.7. ChildrenFloodRoute is not intended for use by children under 13. This app is designed for adult drivers to assess flood risks on roadways.8. Changes to This PolicyWe may update this Privacy Policy from time to time. Any changes will be posted in the App with an updated "Last Updated" date. Your continued use of the App
after any modifications constitutes acceptance of the updated Privacy Policy.9. YOUR CALIFORNIA PRIVACY RIGHTSIf you are a California resident, you have certain rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).Information We Collect.
